I would prefer the market sort this out myself. Someone at Topaz is making changes as if customers can’t just walk away.
I think they have miscalculated.

I also received an email informing me of the upgrade price change. But I upgraded ten days ago and inadvertently made the upgrade purchase twice. So I have purchased until September 2026

I have a little trouble with English, it’s not my first language. I use a translator to help me.
Hello.
Topaz transactions system should’ve automatically cancelled the second payment or refund the amount. Contact Topaz ASAP.
If Topaz fails to assist you, we never had that problem to be clear, contact your bank about the unintentionally double transaction. Good luck.
Part of the confusion here is that you don’t own anything. It says so in the EULA and always has. Essentially for money, you get to use the software and that’s it. I’m not saying this is right or wrong. I’m just saying this is a standard software agreement.
As long as the purchased upgrade will actually pay me until September 2026, I’m fine with that.
When I pay by credit card over the internet, I have verification set up and this time the payment went through without it so I thought I made a mistake somewhere in the order and repeated the payment.
It’s not an ussue with “ownership”, it’s that the new EULA makes the softare a subscription service. The licens works for one year, and then we have to pay up, or remove the software.
Someone posted a link to a “fix” that brings us back to pay once, use forever. However that “fixed” EULA still includes the Darth Vader rug-pull luanguage saying they can alter the agreement at any time at which point we must agree or remove the software…
So the perpetual license luanguage of the “fixed” EULA is just a Trojan Horse if they don’t also fix the rug-pull clause.
Well the great thing about all the user comments here is that we’re really getting a lesson in good and bad EULAs. I really appreciate the folks that have spent the time reading the agreement and dissecting it.
Personally, I find the conditions of the new EULA not acceptable.
We can change anything we want whenever we feel like it is a pretty standard EULA trapdoor, so the deal you signed up for may not be the one you end up with—see the former sales pitch free updates forever.
EULA - my 2 cents
I’m not an attorney and really trying to understand the EULA made my head hurt. With all the chatter on this forum, Topaz should at least say something.
My subscription doesn’t expire until April 2025. The email I received says if I sign up for the auto-renewal, the first one will cost $84 and after that I get 15% off. They will not charge me until next April. If I decide to cancel, I just remove the charge card from my profile. Will I sign up? I have until Oct 2nd. I am thinking about it.
Bottom line is that if I want to use the software, I want to keep getting updates. So if I decided in the future to stop using it, then I will stop getting updates and uninstall it to save disk space. So I really don’t care about not being able to use the software if I stop renewing the license.
Enough said
The current EULA makes no mention of us being able to keep using the software after the 12 month upgrade period.
This is incorrect, you can view the latest EULA on our website.
The perpetual license will not change - you will continue to be able to access the software.
Auto-renewal is also entirely optional, and does not affect that license structure.
That language only applies to the Pro subscription. Please read the EULA carefully if you so desire - seeing a lot of incorrect interpretations here.
I’ll try to clear up some confusion here but I can’t answer every question. Will do my best!
Cheers,
Dakota Wixom
This is incorrect - in latest EULA it is specified that you will be able to continue to use the software after the 12-month period of access to updates has expired. There is no change here.
I can certainly do a post on this later in more detail, but rest assured - these interpretations being posted here are not accurate, and wouldn’t make any sense.
Much of the confusion here is probably coming from the Pro license - which IS a standard subscription.
Auto-renewal is also entirely optional, and does not affect that license structure.
Hope that makes sense.
Seeing a lot of confusion in this thread - please make sure you are reading the latest EULA posted.
Hello - just clarifying that this is definitely not correct. Only the Pro version of the software is a subscription in this sense.
The individual version with auto-renewal is an auto-upgrade, but still a perpetual license.
So if this is the case why not make it a little bit easier for us who either do not speak English natively and struggle with legal vocabulary or just can’t seem to find that kind of assuring paragraph in the EULA by actually quoting the relevant parts stating this? Preferably with the “number” of that section?
I think it’s fair to say that this change have stirred up a fair amount of discomfort, and just saying "this is not correct, read the EULA doesn’t really offer anything to the contrary.
Heck, I was lucky growing up in a country (Sweden) where almost nothing on TV is dubbed, music is delivered in English and schools start teaching English early, meaning have had English in my life for about 45 of my 52 years. I still don’t get the EULA.
That’s totally fair - unfortunately most legal documents are pretty hard to parse. They certainly don’t make for great evening reading material.
But I’m definitely seeing some posts here that are incorrect interpretations of the license structure set forth in the EULA. I’ll do my best to answer any questions here of course.
So if a lot of the new stuff is directed at the pro users maybe there needs to be a greater effort in splitting the pro and consumer version up with their own individual EULA’s, separate forum threads and such.
I did comment on something similar when the GAI release notes started talking about Pro users and whatever extra they would get as opposed to the plain amateur user. And you kind of agreed if I don’t remember it incorrectly.
So… Maybe being a bit more on top of things from the start? Maybe I’m not that far off the mark with my suggestion of actually having a separate thread with a bit of "question/concern #1 - Reply #1 - You find this in… In the EULA?
As it is now the better parts of this thread is dedicated to concerns that someone should have anticipated which isn’t exactly fair to anyone having actual technical issues with this release…
That would be great - unfortunately we bundle the software in a way where this wouldn’t be easily doable but it’s something I’ll certainly look at for the future.
Yeah that’s totally fair. I may edit the thread here for some additional clarity. To be honest it’s actually useful to see what questions arise in these threads because it allows us to put documentation on our site addressing those questions - not everybody gets to read these release threads.
Cheers
Hello - this is still the case, there has been no change to the perpetual ownership structure.
Hello - the EULA terms allow for continued ownership of the software after the 12 month period has expired. There is no change here - even if you are on the auto-renew plan.
The only scenario where this would be the case is with a Pro license, which is a true subscription in that sense.
I’ll update the post with this note.
Hope that clarifies things.
